This lawsuit concerned a decision by the Dedalus Foundation, a non-profit organization established by the artist Robert Motherwell, to retract its authentication of a purported Motherwell painting after it had become suspicious that it and other similar works were forgeries. The painting's purchaser, who had obtained the work from a dealer prior to the retraction, then sued the dealer and, in an unusual twist, also sued the Foundation, claiming that it had broken a “promise” to include the painting in the Motherwell
